Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and TrioEdX LLC (“TrioEdX”, “we”, “us”) and govern your use of trioedx.com, the TrioEdX tutoring platform, and the TrioEdX app for Zoom (together, the “Services”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and accounts

  • You must be at least 18, or have the permission and supervision of a parent or guardian who agrees to these Terms on your behalf.
  • You must give accurate information and keep it up to date. You are responsible for activity under your account and for keeping your sign-in details secure.
  • Tutors are approved through our “Become a Tutor” process. We may decline or remove a tutor at our discretion.

2. The Services

TrioEdX lets students find tutors, book live one-on-one or group lessons, buy lessons, lesson packs and weekly subscriptions, take courses, and message tutors. Tutors are independent and are not employees or agents of TrioEdX.

3. TrioEdX app for Zoom

  • Tutors may connect their own Zoom account so TrioEdX can create, update and delete the Zoom meeting for each booked lesson in that tutor’s account.
  • By connecting Zoom, you authorize TrioEdX to perform those actions using the permissions you approve. You can revoke this at any time by disconnecting in your TrioEdX dashboard or removing the app in the Zoom App Marketplace.
  • You are responsible for your Zoom account and for following Zoom’s own terms of service. Your Zoom plan’s limits (for example, meeting length limits on free accounts) apply to your lessons.
  • If you disconnect Zoom, meetings will no longer be created for new bookings, and you must provide another way to hold your lessons or reschedule them.
  • Zoom is a trademark of Zoom Communications, Inc. TrioEdX is not affiliated with or endorsed by Zoom.

4. Bookings, payments and cancellations

  • Prices are shown at checkout. Single lessons and lesson packs are paid upfront. Weekly plans renew every 4 weeks until you cancel; you can cancel from your dashboard before the next renewal date.
  • Unused lesson-pack lessons remain as credits in your account.
  • Cancellation, rescheduling and refund rules are set out in our Cancellation & Refund Policy.
  • Tutors are paid according to the tutor payout terms shown in the tutor dashboard.

5. Acceptable use

You agree not to:

  • harass, abuse, threaten or discriminate against anyone, or share sexual, violent or otherwise inappropriate content, especially with minors;
  • arrange lessons or payments outside TrioEdX to avoid our fees;
  • record lessons without the consent of everyone present (and, for minors, their parent or guardian);
  • share another person’s personal information without permission;
  • upload malware, scrape the Services, interfere with their operation, or try to access accounts or data you are not authorized to access;
  • infringe intellectual property rights or break any law.

We may suspend or close accounts that break these rules.

6. Content

You keep ownership of content you upload (such as course materials and messages). You give TrioEdX a non-exclusive, worldwide, royalty-free license to host, display and process that content only as needed to provide the Services. TrioEdX’s own site, software, logos and materials belong to TrioEdX and may not be copied without permission.

7. Third-party services

The Services link to or work with third-party services such as Zoom, Google, Apple and payment processors. Their terms and privacy policies govern your use of them, and we are not responsible for them.

8. Disclaimers

The Services are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee any learning outcome, and we do not guarantee that the Services or any third-party service (including Zoom) will be uninterrupted or error-free.

9. Limitation of liability

To the fullest extent the law allows, TrioEdX will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits or data. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim or US$100.

10. Indemnity

You agree to indemnify TrioEdX against claims arising from your breach of these Terms or misuse of the Services.

11. Termination

You may close your account at any time from your dashboard or by contacting support. We may suspend or end your access if you break these Terms. Sections that by their nature should survive termination will survive.

12. Governing law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in New Jersey, unless the law where you live gives you the right to bring a claim locally.

13. Changes

We may update these Terms. If changes are material, we will notify you before they take effect. Continuing to use the Services after that means you accept the updated Terms.
